and/or the GuestDesk web application (collectively, the “Service”) operated by GuestDesk, Bodenhof-Terrasse 89, 6005 Luzern, Switzerland (“GuestDesk”).
These Terms set out the basis upon which GuestDesk provides the Service to you. By registering for an account or using the Service, you declare that you have read, understood and agree to be bound by this Agreement. This Agreement is legally binding and supersedes any prior agreements relating to the Service.
You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of third parties or restrict their use of the website. You shall not take any action that compromises the security, integrity or availability of the website. You shall not attempt to gain unauthorised access to any part of the website or to any data not intended for you. Use of the website is further subject to the applicable Privacy Policy.
GuestDesk provides a digital platform for guest management, invitation management, RSVP tracking, guest list administration, seating coordination and event check-in. In order to use the Service, you must create an account (“Account”). Unless otherwise agreed in writing, use of the Service is subject to payment of the applicable service fees. You agree to use the Service in a fair and responsible manner and not to share your login credentials with unauthorised third parties.
GuestDesk processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP, rev. 2023) and, where applicable, the EU General Data Protection Regulation (GDPR).
For purposes of this Agreement, “Personal Data” means any information relating to an identified or identifiable natural person. “Processing” means any operation performed on Personal Data, whether by automated means or otherwise.
You acknowledge that, in relation to Personal Data of your guests, clients or invitees, you act as data controller and GuestDesk acts as data processor. You remain responsible for ensuring that Personal Data has been lawfully collected and may be processed via the Service. GuestDesk processes Personal Data solely for the purpose of providing and maintaining the Service and will not process such data for its own independent purposes.
GuestDesk implements appropriate technical and organisational measures to protect Personal Data against unauthorised access, loss, alteration or disclosure. GuestDesk will assist you, to the extent required by applicable law, in responding to data subject requests and in fulfilling statutory data protection obligations.
You agree not to use the Service to send unlawful, unsolicited or unauthorised communications. You confirm that all contact details uploaded to the Service have been obtained lawfully and that recipients have consented where required by applicable law to receive communications from you.You shall not use the Service to distribute unlawful, defamatory, misleading, abusive, fraudulent or otherwise inappropriate content. You shall not upload malicious software or attempt to interfere with the proper functioning of the Service. GuestDesk reserves the right to suspend or terminate Accounts that violate these provisions.
This Agreement is concluded for an unlimited period unless terminated in accordance with its provisions. GuestDesk may terminate this Agreement with immediate effect if you materially breach its terms.
The website, the Service, all associated software, branding, content, designs and materials are protected by intellectual property laws and remain the exclusive property of GuestDesk. You are granted a limited, non-exclusive, non-transferable right to use the Service during the term of this Agreement. You shall not copy, reproduce, modify, reverse engineer, distribute or otherwise exploit any part of the Service beyond what is expressly permitted.
Access to the Service requires registration of an Account and payment of the applicable service fee. Fees are due in advance unless otherwise agreed in writing. Prices are indicated in Swiss Francs (CHF) unless stated otherwise. Upon receipt of payment, GuestDesk grants access to the Service for the agreed subscription period or event-based duration. GuestDesk reserves the right to adjust fees for future subscription periods. No refund shall be granted once access to the Service has been provided, unless mandatory Swiss law provides otherwise.
Subscription-based accounts renew automatically unless cancelled before the end of the applicable billing period in accordance with the agreed cancellation terms. If an Account becomes inactive or is terminated, access to stored data may be restricted. GuestDesk may delete data after a reasonable retention period following termination. Early termination by the user does not entitle the user to a refund unless otherwise required by law. In case of termination due to violation of this Agreement, no refund shall be granted.
The Service is hosted on secure infrastructure located in Switzerland and/or the European Union. GuestDesk may use reputable third-party hosting providers. GuestDesk ensures appropriate contractual safeguards in accordance with applicable data protection law. GuestDesk shall not be liable for disruptions caused by third-party infrastructure providers unless caused by intent or gross negligence.
The GuestDesk website and web application use technically necessary cookies to ensure the proper functioning of the Service. Cookies are small text files that are stored on your device when you access the website. GuestDesk uses session cookies for authentication, security, and system functionality. These cookies are required to operate user login sessions, maintain secure access to accounts and ensure stable platform performance. No tracking, marketing or profiling cookies are used. GuestDesk does not use analytics tools, advertising technologies or third-party tracking services. Session cookies are automatically deleted when the browser is closed. Users may configure their browser settings to block cookies; however, doing so may limit the functionality of the Service. For further information on data processing, please refer to the Privacy Policy.
The Service is provided on an “as is” and “as available” basis. GuestDesk does not warrant uninterrupted, error-free or secure operation of the Service. GuestDesk does not guarantee specific business outcomes resulting from use of the Service. To the extent permitted by Swiss law, all implied warranties are excluded.
To the extent permitted by Swiss law, GuestDesk shall be liable only for damages caused by intentional misconduct or gross negligence. Liability for slight negligence is excluded, except where mandatory statutory provisions provide otherwise. In any event, GuestDesk’s total liability under this Agreement shall be limited to the amount of service fees paid by you during the twelve months preceding the event giving rise to the claim. GuestDesk shall not be liable for indirect damages, loss of profits, reputational damage, data loss caused by user actions, or actions of third parties. Nothing in this Agreement excludes liability where exclusion is not permitted under applicable Swiss law.
You agree to indemnify and hold GuestDesk harmless from any claims, damages or expenses arising from your unlawful use of the Service, your violation of applicable data protection laws, or your infringement of third-party rights.
These Terms constitute the entire Agreement between the parties with respect to the Service. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
GuestDesk may amend this Agreement from time to time. The updated version will be published on the website. Continued use of the Service after publication of amendments constitutes acceptance of the revised Terms.
This Agreement is governed by the substantive laws of Switzerland, excluding conflict of law provisions. Exclusive place of jurisdiction for all disputes arising out of or in connection with this Agreement is Luzern, Switzerland.
